However, navigating the legalities of the <b data-path-to-node=\"6\" data-index-in-node=\"133\">domestic helper contract<\/b> and immigration rules can feel daunting. At <b data-path-to-node=\"6\" data-index-in-node=\"202\">HelperChoice<\/b>, we\u2019ve simplified the most common questions to help you prepare for a successful and ethical hiring journey.<\/p>\n<p><img fetchpriority=\"high\" decoding=\"async\" class=\"alignnone size-full wp-image-15383\" src=\"https:\/\/www.helperchoice.com\/c\/wp-content\/uploads\/2023\/04\/What-You-Need-to-Know-to-Hire-a-Domestic-Helper-in-Hong-Kong.png\" alt=\"What you need to know to hire a domestic helper in hong kong\" width=\"800\" height=\"550\" \/><\/p>\n<h2><span class=\"ez-toc-section\" id=\"What_does_the_standard_employment_contract_include\"><\/span>What does the standard employment contract include?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>The employment contract clearly stipulates t<strong>he allowed duties, the living conditions, the minimum wage and other labour-related regulations<\/strong>.<\/p>\n<p>The employment contract is relatively straightforward because you can only use the Standard Employment Contract <a href=\"https:\/\/www.immd.gov.hk\/eng\/forms\/forms\/id407.html\" target=\"_blank\" rel=\"noopener\">provided by the Hong Kong Immigration Department.<\/a> There is no need for an employer to draw up their own contract and terms.<\/p>\n<p>Each contract has <strong>4 copies<\/strong> and all these need to be filled out. The copies are for: <strong>the domestic helper, the employer, the sending Consulate and the Immigration Department.<\/strong> You can get the original copies of the domestic helper standard employment contract can at 2\/f of the Immigration Tower at Wan Chai.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Abiding_by_the_employment_contract\"><\/span>Abiding by the employment contract<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>The domestic helper employment contract is a legally binding document under the Hong Kong labour law and it will be submitted to the Immigration Department. Therefore, it is of utmost importance that you are aware of what you sign. If an employment agency rushes over the employment contract, <strong>tell them to slow down <\/strong>and if something is unclear, <strong>ask them to explain the contract again<\/strong>. <strong>Always keep a copy of the contract<\/strong> in a safe place so that you can refer to it when needed.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"The_main_provisions_of_the_Standard_Employment_Contract\"><\/span>The main provisions of the Standard Employment Contract<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<h3><span class=\"ez-toc-section\" id=\"Duration\"><\/span>Duration<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p><strong>The contract is set for 2 years<\/strong> (clause 2)<strong>.<\/strong> It can be terminated by any party with a 1 month notice period (clause 10). It cannot be extended: upon expiry of the contract, the employer and the helper who agree on the continuation of employment must sign and submit a new contract (clause 13).<\/p>\n<h3><span class=\"ez-toc-section\" id=\"Location_the_live-in_rule\"><\/span>Location: the live-in rule<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>The employment contract <strong>requires a foreign domestic helper to live at the employer\u2019s address where she also works <\/strong>(clause 3). The employer must ensure that free \u201csuitable accommodation and reasonable privacy\u201d is provided as the living arrangement (clause 5b), but it is not clearly specified what the government exactly means by \u201creasonable\u201d, in particular when it comes to the size of the room, as well as its location in the flat.<\/p>\n<p>That said, according to the standard employment contract, domestic helpers should not sleep in the same room as anyone of the opposite sex unless they are children (note: they cannot be teenagers). At <strong>HelperChoice<\/strong>, we also advise employers to provide a room which the only purpose is accommodation, meaning that the room does not contain a washing machine, for example. Parties who violate this clause is violating the Immigration Ordinance and may face legal consequences.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"Remuneration_and_expenses\"><\/span>Remuneration and expenses<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>The monthly wages paid by the employer to the helper <strong>cannot be less than <a href=\"https:\/\/www.helperchoice.com\/c\/domestic-helper\/helper-minimum-wage\">the minimum legal allowable wage<\/a><\/strong> (clause 5a). In addition, the employer shall provide the Helper with <strong><a href=\"https:\/\/www.helperchoice.com\/c\/domestic-helper\/salary-food-allowance\">free food or a food allowance per month<\/a><\/strong> (clause 5b). This is not only due to the job nature as taking care of children starts early in the morning and ends late at night in Asia, but also because the foreign domestic helpers live at their employer\u2019s house and are therefore often instantly \u2018on-call\u2019.<\/p>\n<p>We do not advise employers to make their domestic workers work more than 12 hours as it is inhumane and it is important that they get a good rest at night.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"Additional_concerns\"><\/span>Additional concerns<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>There are a lot more other issues that cannot be addressed by the employment contract or the law. For example, should there be a <a href=\"https:\/\/www.helperchoice.com\/c\/domestic-helper\/rest-day\">curfew on the domestic helper\u2019s day off<\/a>? Is the domestic helper allowed to <a href=\"https:\/\/blog.helperchoice.com\/smartphones-and-domestic-helpers\" target=\"_blank\" rel=\"noopener\">use her mobile phone<\/a> during the day? If the <a href=\"https:\/\/blog.helperchoice.com\/pregnancy-domestic-helper\/\" target=\"_blank\" rel=\"noopener\">domestic helper is pregnant<\/a>, can she be exempted from certain duties? For all these, it is very important that you and your domestic helper <a href=\"https:\/\/blog.helperchoice.com\/how-to-handle-domestic-helper-problems\/\" target=\"_blank\" rel=\"noopener\">communicate to find a solution.<\/a><\/p>\n<h2><span class=\"ez-toc-section\" id=\"After_an_employment_contract_starts\"><\/span>After an employment contract starts<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<h3><span class=\"ez-toc-section\" id=\"Changing_residence_address\"><\/span>Changing residence address<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>If you have moved, you need to update the address on the domestic helper employment contract. You should complete the form <strong><a href=\"https:\/\/www.immd.gov.hk\/eng\/forms\/forms\/id407g.html\" target=\"_blank\" rel=\"noopener\">\u201cRevised Schedule of Accommodation and Domestic Duties\u201d (ID407G)<\/a><\/strong> and submit it to the Immigration Department.<\/p>\n<p>If you are moving to a flat in a housing estate run by the Housing Department\/Hong Kong Housing Society, you need to produce a letter of consent from the Housing Department\/Hong Kong Housing Society granting permission for your domestic helper to reside in the premises and a copy of the tenancy agreement.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"Renewing_employment_contract\"><\/span>Renewing employment contract<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>Sometimes you need to apply for 2 visas, 1 for entry and the other for extension of stay if you wish to <a href=\"https:\/\/www.helperchoice.com\/c\/domestic-helper\/contract-renewal\">renew the employment contract<\/a> of the same domestic worker. It is because according to the employment contract, your worker is entitled to a home leave after the 2-year contract is completed. The entry visa is applicable in all times if you wish to renew your domestic worker\u2019s contract, but only when you cannot immediately give your domestic helper her <a href=\"https:\/\/www.helperchoice.com\/hong-kong\/hk-labour-department-domestic-helper\" target=\"_blank\" rel=\"noopener\">vacation leave<\/a> would you need to apply for the extension of stay visa.<\/p>\n<p>See also: <a href=\"https:\/\/www.helperchoice.com\/c\/domestic-helper\/contract-renewal\"><em>Domestic Helper Contract and Work Visa Renewal<\/em><\/a><\/p>\n<h3><span class=\"ez-toc-section\" id=\"Terminating_domestic_helper_employment_contract\"><\/span>Terminating domestic helper employment contract<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>Both you and your domestic helper can <a href=\"https:\/\/www.helperchoice.com\/c\/domestic-helper\/termination\">terminate the contract<\/a> by giving not less than 1 month\u2019s notice in writing or by paying 1 month\u2019s wages to the other party. Within 7 days of termination, you should notify the Foreign Domestic Helpers Section of the Immigration Department in writing of the termination.<\/p>\n<p>Other than that, you and the helper need to work together to settle all the outstanding wages, holidays, severance payment, long service payment, etc.<\/p>\n<p>See also: <em><a href=\"https:\/\/www.helperchoice.com\/c\/domestic-helper\/termination\">Domestic Helper Contract Termination<\/a><\/em><\/p>\n<h4><span class=\"ez-toc-section\" id=\"Severance_payment\"><\/span>Severance payment<span class=\"ez-toc-section-end\"><\/span><\/h4>\n<p>The <a href=\"https:\/\/www.helperchoice.com\/c\/domestic-helper\/severance-payment-long-service-payment\">severance payment<\/a> is applicable if your domestic helper is dismissed or if the contract is not being renewed<\/p>\n<ul>\n<li>by reason of <strong>redundancy<\/strong> (such as due to relocation or the fact that the children your worker is taking care of have grown up) and<\/li>\n<li>if the domestic helper has at least completed a two-year contract with you<\/li>\n<\/ul>\n<h4><span class=\"ez-toc-section\" id=\"Long_service_payment\"><\/span>Long service payment<span class=\"ez-toc-section-end\"><\/span><\/h4>\n<p>The <a href=\"https:\/\/www.helperchoice.com\/c\/domestic-helper\/severance-payment-long-service-payment\">long service payment<\/a> is applicable when the domestic helper has worked for you for no less than 5 years and fits into 1 of these situations:<\/p>\n<ul>\n<li>dismissed or not renewed by reason other than serious misconduct or redundancy (such as considering the worker not capable enough);<\/li>\n<li>considered permanently unfit for the job and is certified by a registered medical practitioner;<\/li>\n<li>aged 65 or above when she resigns;<\/li>\n<li>dies in service<\/li>\n<\/ul>\n<p>Note that a domestic helper is <strong>not entitled to both <a href=\"https:\/\/www.helperchoice.com\/c\/domestic-helper\/severance-payment-long-service-payment\">long service payment and severance payment<\/a> at the same time<\/strong>.
