In the Hong Kong domestic labor market, the “rest day” is often a source of confusion for both new and experienced employers. Under the Employment Ordinance, every foreign domestic helper (FDH) is entitled to a continuous 24-hour rest period every week.

The 24-Hour Rule: What Does the Law Say?

A rest day is defined as a continuous period of not less than 24 hours.

  • The “No Work” Mandate: You cannot legally compel your helper to work on their rest day. This includes “light” chores like preparing breakfast or answering the door.

  • Voluntary Work: While a helper can choose to work on their rest day, they must do so voluntarily, and you must provide an alternative rest day within 30 days.

  • Scheduling: Rest days can be appointed on a fixed or irregular basis. If irregular, you must notify your helper of the rest day at least once at the beginning of each month.

Curfews and the “Live-in” Rule

The “grey area” of rest days often revolves around when a helper should return home. Here is how to navigate this in 2026:

Can I Impose a Curfew?

Technically, the law does not specify a “return time,” only that the rest day is 24 hours. If your helper starts her rest day at 9:00 PM on Saturday, her 24-hour period ends at 9:00 PM on Sunday.

  • Practical Advice: Respect that your helper is an adult. Most employers find that a reasonable “lights out” time (e.g., 10:00 PM or 11:00 PM) works best to ensure the household isn’t disturbed.

  • Childcare Considerations: If your helper shares a room with a child, discuss a return time that doesn’t disrupt the child’s sleep schedule. Communication, not coercion, is key.

Staying Out Overnight

Under the Immigration Department’s “Live-in Requirement,” domestic helpers must reside at the contractual address listed in their employment contract.

  • Overnight Rule: While a helper has 24 hours of freedom, they should not “live out” overnight regularly, as this may violate the terms of their visa. However, they are free to spend their entire day away from the house until their designated return time.

Special Situations & Boarding Houses

Protests, Epidemics, or Emergencies

In cases of public health concerns or safety emergencies, a helper may choose to stay at the employer’s home during their rest day.

  • Important: If your helper stays home for safety, they are still on their rest day. You must not assign them any duties. They should be allowed to rest, use their phone, and relax without interruption.

Boarding Houses

If a contract has been terminated or a helper is in between jobs, they may stay at boarding houses (regulated by NGOs or private owners). These are temporary solutions during the “14-day rule” period after a contract ends.
